THE FOLLOWING CONTEST IS INTENDED FOR PLAY IN ALL CANADIAN PROVINCES AND ALL 50 US STATES ONLY. DO NOT ENTER THIS CONTEST IF YOU ARE NOT LOCATED IN CANADA OR THE US.

Eligibility:

The Point2 Contest (the “Contest”) is open only to legal residents of all provinces in Canada and all 50 US states who are at least eighteen (18) years of age at the time of entry and who have Internet access and valid e-mail and Facebook accounts at the time of entry. Promotion is subject to all federal, state and local laws and regulations.

Entrants must submit all required information to be eligible to win. Entries missing required information will be disqualified. Employees of Point2 (“the Sponsor”) and their affiliated companies, subsidiaries, vendors, and their respective advertising and promotion agencies (collectively, the “Contest Entities”), and the immediate families (defined as parents, siblings, spouses and children and their spouses) and household members of each such employees are not eligible. Participation in this Contest constitutes entrant’s full and unconditional agreement to abide by these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Contest. Winning any of the prizes offered is contingent upon fulfilling all requirements set forth herein.

Timing:

The Contest begins October 27, 2014 at 12:00 a.m. Eastern Time and ends on November 1st, 2014 at 11:59 p.m. Eastern Time (the “Entry Period”).

How to Enter:

To enter online, take the following steps during the Entry Period:

Step 1: Upload the photo containing your Halloween home decorations in the contest application found on the Sponsor’s Facebook page; you may also upload photos directly from your Facebook account.

Step 2: Fill in the form with the required information (Where the photo was taken, First Name, Last Name, Email) and hit the “Continue” button.

ENTRY LIMIT: Only one (1) photo per person and per social media account.

If any entrant is found to have used multiple or different Facebook accounts, or other applicable accounts to enter the Contest, such entrant will be disqualified. Entries that are late, stolen, false, illegible, or incomplete, or that do not conform with or satisfy any or all of these Contest rules will be disqualified. Sponsor has no obligation to advise an entrant of an incomplete or otherwise non-compliant entry. No mailed, telephoned, faxed, or mechanically reproduced entries will be accepted. Proof of submission of an entry will not be deemed proof of receipt. In the event of a dispute as to any entry, the authorized account holder of the Facebook account used to enter will be deemed to be the entrant. The “authorized account” holder is the natural person assigned the e-mail account. Potential winners may be required to show proof of being the authorized account holder.

Judging:

The jury will be formed by 2 Point2 Homes representatives. In the case of a tie, a third Point2 Homes representative will be asked to vote.
The jury will select 3 (three) winning photos from the ones which entered the contest based on the following criteria:
a. Photographic quality (50%)
b. Relevance (25%)
c. Creativity (25%)

Prize Awarding:

On November 4, 2014, after the end of the Promotion Period, three persons will be drawn randomly and will be awarded each a $150 Amazon® Gift Card. There will be a total of three (3) Amazon® Gift Cards awarded, for a total of $450.

Except as it may be expressly warranted herein, any Contest prize is provided “as is” without further warranty of any kind. Winner must comply with applicable terms and conditions of Amazon® when using the gift card.

Each entrant is responsible for monitoring his/her e-mail account for prize notification. If a potential prize winner cannot be reached by Sponsor within fifteen (15) days, using the contact information provided at the time of entry, that potential prize winner shall forfeit the prize. Prizes may not be awarded if an insufficient number of eligible entries are received.

Publicity:

Except where prohibited, participation in the Contest constitutes entrant’s consent to Contest Entities and their agents to the use of entrant’s name, likeness, photograph, voice, opinions and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

Entrant’s Personal Information:

Any information provided by the entrant in order to enter the Contest is made available only to the Sponsor and the Contest Entities. Further, information collected from entrants is subject to the Sponsor’s privacy policy. However, the Sponsor is entitled to use the information provided by the entrant for marketing and promotional purposes.

General Conditions:

The Contest Entities reserve the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failure or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by the Contest Entities in their sole discretion. The Contest Entities reserve the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Official Rules or those of any other promotion or in an unsportsmanlike or disruptive manner.

Limitations of Liability:

The Sponsor and Contest Entities are not responsible for:

(1) any incorrect or inaccurate information, whether caused by entrants, or by any of the equipment or programming associated with or utilized in the Contest;

(2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software;

(3) unauthorized human intervention in any part of the entry process or the Contest;

(4) technical or human error that may occur in the administration of the Contest or the processing of entries;

(5) late, lost, undeliverable, damaged or stolen mail; or

(6) any and all liability for any injuries, loss, or damage of any kind arising from or in connection with this Contest or any prize won, including any injuries, loss or damage of any kind arising from or in connection with participation in the Contest.

If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Contest, provided that, if it is not possible to award another entry due to discontinuance of the Contest, or any part of it, for any reason, the Contest Entities, in their sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. No more than the stated number of prizes listed above will be awarded.

Nothing in these Official Rules shall be deemed to exclude or restrict any of the winners’ or entrants’ statutory rights as a consumer.

All trademarks and trade names mentioned herein are the trademarks and trade names of their respective owners and are used herein for identification purposes only, and do not represent an endorsement or sponsorship of the contest.

Affidavit & Release. As a condition of being awarded any prize, each winner may (in Sponsor’s sole discretion) be required to execute and deliver to Sponsor a signed affidavit of eligibility and acceptance of these Official Rules and release of liability, and any other legal, regulatory, or tax-related documents required by Sponsor in its sole discretion.
