Colo. Rev. Stat. § 38-12-103 (1) requires that the landlord return my security deposit, in this case, within 60 days.
Colo. Rev. Stat. § 38-12-103 (4) requires that "[u]pon [sale] of his interest in the dwelling unit...the landlord, his agent, or his executor, shall, within a reasonable time:
(a) Transfer the funds...to the landlord's successor...and notify the tenant by mail of such transfer and of the transferee's name and address; or (b) Return the funds...to the tenant."
I'd lived at Archer Tower between May 2021 and May 2024, with all three leases signed under ownership listed as "Urban Neighborhood Denver Archer Tower LLC". The complex was owned by Local by Laramar, then Greystar, and now I guess it's back to Local by Laramar.
It's now been 72 days and there's no check for our security deposit in sight, nor has anyone reached out. I was called by an office worker who told me I had to go after Greystar for this deposit--however, my lease was with Archer Tower, listed as ownership above. They provided no contact details nor did they give me anything other than an incredulous attitude.
I don't care who owns this complex. I am not privy to the changes in ownership entities and the details involved--my security deposit should've been sent promptly regardless of who owns it, and it shouldn't be my job to hunt people down.
I do not recommend this location if you want to work with an apartment complex that follows Colorado law and doesn't engage in shady business practices. Both owners have a history of making it very difficult for tenants to communicate directly with management and to receive deposits back without a fight, so good luck to anyone who decides to give them their money.
